Steps toward a family-based visa

If you are a citizen, you are allowed to bring to the United States your spouse, unmarried children younger than 21, and parents older than 21. Grandparents, aunts, uncles, cousins and in-laws are typically not eligible. There are limits on the number of immigrants allowed into the United States each year, and your application is likely to be delayed if that number already has been met. You should work with a qualified immigration attorney for assistance with:

  • Filing forms. The first step toward receiving a family immigration visa is filing a Petition for Alien Relative, Form I-130, with the U.S. Citizenship and Immigration Services (USCIS).
  • Documentation. After filing the petition, you must provide a number of documents to the federal government, including passports, an affidavit of support, and marriage and birth certificates.
  • Interview. Embassy or consulate officials interview all applicants before a visa is issued. Our team can prepare you for this interview.

Advice on deferred action for childhood arrivals

In addition, a recently passed law allows immigrants who entered the country illegally to apply for work visas without having to return to their home country and risk being barred from returning to the United States for up to 10 years.
