Each year, about 140,000 foreign nationals are allowed into the United States on work visas. There are often many more applicants than available positions, and the process of applying can be long and confusing.

To be considered, your prospective employer must complete a labor certification. If that clears, you can fill out the necessary paperwork and provide a passport, medical examination forms and other documents. Then, embassy or consulate officials will interview you.

Visas are available for many types of workers

The United States provides visas for a variety of workers, including high-ranking managers and unskilled laborers, ranked by priority. Workers are classified as follows:

  • First preference. These individuals have extraordinary abilities in the fields of science, art, education, business or athletics, or they may be professors or researchers with three or more years of teaching experience who are pursuing a tenure track position. This option is also open to managers or executives who have been working overseas for an affiliate or subsidiary of a U.S. company.
  • Second preference. Workers in this category include those with advanced degrees and at least five years of professional experience or those with exceptional abilities in science, art or business.
  • Third preference. This category includes skilled workers in jobs that require at least two years of experience or an undergraduate degree. Unskilled workers in positions requiring fewer than two years of training who are not temporary or seasonal also qualify.
