ICE Raids Detain 40 Immigrants in NYC

Reported raids by Immigration and Customs Enforcement (ICE) officials have created a sense of panic among the documented and undocumented immigrants in various sanctuary cities including New York, San Francisco, Oakland, Los Angeles, Chicago and Washington, D.C. Indeed, this past week ICE confirmed 40 arrests in the New York City area alone. As many of you are aware, President Trump recently signed an Executive Order to crack down on undocumented immigrants with criminal records who should be targeted by ICE officials. If ICE detains you, a friend, or a family member, or if agents show up at your home, you should know your rights.

Reportes de redadas ejercidas por del Servicio de Inmigracion y Aduana (ICE) han causado un sentido de panico entre los inmigrates documentados e indocumentados en las ciudades que ofrecen santuario como San Francisco, Oakland, Los Angeles, Nueva York, Chicago y Washington D.C.  Por ejemplo, esta pasada semana ICE confirmo 40 arrestos solamente en la ciudad de Nueva York.  Como muchos de ustedes sabran, el presidente Trump recientemente firmo una orden ejecutiva para agresivamente buscar cualquier inmigrante indocumentado con archivo criminal utilizando a los agentes de ICE.  Si los agentes de ICE lo detienen a usted, a un miembro de su familia o llegan a su residencia, usted debe de saber sus derechos.

 

#1ICE agents may detain a person in a public setting with an administrative warrant; however, an administrative warrant does not give ICE agents permission to enter your home. ICE agents may only enter your home if you give them permission to come in. You are not obligated to answer or open the door. Still, you should be aware if you do not open, ICE agents will likely return. If ICE agents show up at your residence, we would highly recommend you contact us.

Los agentes de ICE pueden detener a una persona en zonas publicas con una orden de arresto administrativa; pero, una orden de arresto administrativa no le da derecho a los agentes de ICE a entrar a su casa. De la unica manera que los agentes de ICE pueden entrar a su casa es si usted les da el permiso para hacerlo. Usted no esta obligado a contestar o abrir la puerta. Entienda, debe estar consiente que si no contesta la puerta los agentes de ICE lo mas seguro regresaran. #2You should speak with a family member or friend and have an emergency plan in place. Your family member or friend should have access to financial resources and personal documents to assist you with legal representation.

Debe hablar con un miembro de su familia o amigo cercano y tenga un plan de emergencia preparado. El miembro de su familia o amigo debe tener acceso a recursos economicos y documentos personales para asistirlo a usted con representacion legal.

 

#3You have a right to remain silent. Calmly inform Ice agents that you wish to exercise this right. You are not obligated to speak or answer questions. If you decide to speak, remember anything you say can be used against you.

Usted tiene el derecho de permanecer callado.  Calmadamente informele a los agentes de ICE que usted desea ejercer este derecho. Usted no esta obligado a hablar o contestar preguntas.  Si usted decide hablar, recuerde que todo lo que diga puede ser usado en su contra.

 

#4Do not sign any documents provided by Ice agents unless you have a lawyer present. This will undoubtedly frustrate Ice agents; however, you want to protect your rights and are not obligated by law to sign anything no matter what the agents tell you.

No firme documento alguno que provenga de los agentes de ICE hasta que tenga un abogado presente. Esto va a causarle molestia a los agentes de ICE; pero, usted quiere proteger sus derechos.

 

#5Do not, under any circumstances, lie to ICE agents. Also do not give them any documents, including, but not limited to passports, unless they have a warrant.

#6If ICE shows up at your door, ask if they have a warrant. Ask if they will leave their information at the door. Be aware that ICE agents may try to trick you into opening the door for them by pretending to be other people.
