Extending Your Visa Can Be Time Consuming


The US Citizenship and Immigration Services (USCIS) is now resuming Premium Processing for nonimmigrant religious worker petitions filed by certain R-1 petitioners. However, only petitioners who have passed the on-site inspection are eligible to file under the Premium Processing Service.
On-site inspections were not always the norm.  However, once a Benefit Fraud Assessment was performed, the USCIS put in the site inspection requirement as part of the adjudication process for religious worker petitions.  Because of this new requirement, Premium Processing was suspended for R-1 nonimmigrant religious worker visa petitions.
The Premium Processing Service guarantees either an approval or denial notice, or a request for evidence, within 15 calendar days of the receipt of the petition. This service has an addition $1,000 processing fee.  If the petition cannot be processed within the 15 days, USCIS will refund the additional processing fee and process the application under standard procedures. Extending a visa in the United States
The Department of Homeland Security grants permission to enter and remain in the United States. When a Visa should be extended
If there is a date on Form I-94, you should apply for a visa extension far in advance of the expiration. It is recommended that the extension is applied for at least 45 days before the authorized stay expires. The USCIS has to receive the application to extend by the day that the authorized stay expires.
